Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://tungsacupuncture.org website (the “Service”) operated by Master Tung's Acupuncture (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password you use to access the Service and for any activities or actions that occur under it, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any security breach or unauthorized use of your account.

You agree not to share your account access with others. Each account is for individual use only, and sharing access credentials is strictly prohibited.

Course Purchases and Payments

Payment Terms

When you purchase a course through our Service, you agree to pay all fees associated with the course. All fees are in US Dollars (USD) and are non-refundable except as expressly set forth in these Terms.

Payment Processing

Payments are processed through our third-party payment processor. By making a purchase, you agree to be bound by the payment processor’s terms of service and privacy policy in addition to these Terms.

Pricing and Taxes

We reserve the right to adjust pricing for our courses at any time. Any price changes will not affect courses you have already purchased.

You are responsible for paying all taxes associated with your purchases. Prices displayed do not include taxes, which will be calculated and added at checkout based on your location.

Refunds

All purchases are final and non-refundable unless otherwise specified for a particular course. If you believe you are entitled to a refund, please contact us at support@tungsacupuncture.org within 7 days of purchase.

Cancellation Policy

In accordance with the Israeli Consumer Protection Law (Consumer Protection (Cancellation of Transaction) Regulations, 2010 and the Consumer Protection Law, 1981), you are entitled to cancel your purchase within a specified period after the transaction. To initiate a cancellation, please contact us at support@tungsacupuncture.org within 7 days of purchase. All refunds will be processed according to the guidelines provided by the law.

Course Access and License

License Grant

When you purchase a course, we grant you a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial, educational purposes only.

Access Period

Unless otherwise specified, your access to purchased course content is for the period specified at purchase. Some courses may offer lifetime access, while others may have a defined access period.

Restrictions

You may not:

  • Copy, reproduce, distribute, publicly display, publicly perform, or create derivative works of the course materials
  • Share your login credentials or course access with others
  • Use the course materials for any commercial purpose
  • Remove any copyright or other proprietary notices from the course materials
  • Transfer the materials to another person or “mirror” the materials on any other server

Continuing Education Credits

CE/CME Credits

Our courses may be eligible for continuing education credits for various licensing bodies. While we strive to ensure our courses meet the requirements for the organizations we list, we cannot guarantee that our courses will be accepted by your specific licensing board or professional organization.

User Responsibility

It is your responsibility to verify that the courses you take through our Service meet the continuing education requirements for your specific license, certification, or professional membership before purchasing.

Certificates

Upon successful completion of a course, we will provide a certificate of completion. We will maintain records of your course completion for a minimum of 5 years.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Shaun Goodman and its licensors. The Service is protected by both Israel and foreign countries’ copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Shaun Goodman.

User Conduct

By using our Service, you agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service.
  • Use the Service to harm minors in any way.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to parts of the Service that are restricted.
  • Use any robot, spider, or other automatic device to access the Service.
  • Introduce any malware, viruses, or other malicious code.
  • Collect or track the personal information of others.

User Content

If our Service allows you to post, submit, or transmit content (such as forum posts, comments, or questions), you retain all rights in such content.

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with the Service.

You represent and warrant that you own or control all rights to the content you post and that such content does not violate these Terms.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Shaun Goodman.

Shaun Goodman has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Master Tung’s Acupuncture shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services you visit.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms that should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Medical Disclaimer

The content provided through our courses is for educational and informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have learned through our courses.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. In no event shall Shaun Goodman, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Service.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service.

Dispute Resolution

Any dispute arising from or related to these Terms shall be initially submitted to informal dispute resolution through good-faith negotiation between you and Shaun Goodman.

If a dispute cannot be resolved through informal means, it shall be resolved through binding arbitration to be conducted in Jerusalem, Israel, in accordance with the rules of the Israeli Institute of Commercial Arbitration.

Governing Law

TThese Terms shall be governed and construed in accordance with the laws of Israel without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you disagree with the new terms, please stop using the Service.
